The Archivist's refusal to publish the Equal Rights Amendment is a disheartening decision that undermines the public interest and prevents the United States from upholding its international legal obligations to eliminate sex discrimination. Despite meeting all constitutional requirements, including being ratified by the necessary number of states, the Archivist has chosen to ignore the will of the vast majority of Americans who support this bipartisan measure. This inaction contradicts legal guidance from the American Bar Association affirming the ERA's validity as the 28th Amendment. It also defies a recent communication from the UN Special Rapporteur on violence against women urging the ERA's immediate publication to strengthen protections against sex discrimination in the US. The Equal Rights Amendment is a crucial step towards enshrining equality in the highest law of the land. Its publication is long overdue. I urge you to take immediate action to direct the Federal Archivist to publish the ERA without further delay. Women in America have waited over a century for their rights to be fully recognized – it is past time to ensure constitutional equality for all.
