I am writing to express my deep concerns regarding the ongoing transition process for the 2024 presidential election, particularly the involvement of private individuals like Elon Musk in roles of public governance and their interactions with foreign nations. These actions raise critical questions about transparency, conflicts of interest, and adherence to the rule of law. Reports indicate that President-elect Donald Trump is considering Elon Musk for a government efficiency commission. While efficiency in government is a laudable goal, this appointment raises significant ethical and practical concerns. Musk's vast business empire—including Tesla, SpaceX, and Starlink—has benefitted extensively from federal contracts and subsidies. Appointing him to a government position creates glaring conflicts of interest that could undermine public trust and accountability. Moreover, Musk’s reported communications with Iran and other foreign nations further complicate his involvement. As a private citizen, Musk is not authorized to engage in diplomatic relations. Such actions could violate the Logan Act, which prohibits unauthorized individuals from conducting diplomacy with foreign governments. Regardless of legal interpretations, these communications are deeply inappropriate and could undermine U.S. foreign policy goals. Additionally, this situation occurs against the backdrop of other concerning developments in the transition process, including incomplete campaign finance disclosures and attempts to circumvent Congressional oversight for cabinet appointments. These actions challenge the integrity of our democratic institutions and demand immediate attention from oversight bodies. I respectfully urge Congress, the Department of Justice, and all relevant oversight committees to: Investigate Elon Musk’s communications with foreign nations to determine whether they violate U.S. law. Evaluate potential conflicts of interest if Musk is appointed to a formal government position. Ensure that all presidential appointments and actions comply with legal and constitutional requirements. The American people deserve a government that operates transparently and upholds the highest ethical standards. Allowing these actions to proceed unchecked would set a dangerous precedent and weaken our democracy. Thank you for your attention to these critical issues.
