I am writing to urge support for the Online Pricing Transparency Act, ensuring app stores and developers disclose all mandatory costs, such as memberships or one-time fees, in app descriptions before download. The Act would also restrict personal data collection until users are informed of costs and provide consent. This Act is vital to protect consumers from misleading practices and ensure informed decisions in an increasingly digital marketplace. Transparency and data privacy are fundamental rights that must be safeguarded as technology plays a growing role in our lives. I respectfully request your support in advancing this critical legislation. --- Online Pricing Transparency Act Section 1. Short Title This Act may be cited as the “Online Pricing Transparency Act.” Section 2. Findings Congress finds that: 1. Many software applications marketed as "free" include undisclosed mandatory costs, such as memberships or one-time purchases, to access essential functionality. 2. The lack of upfront disclosure misleads consumers, depriving them of the ability to make informed decisions before downloading software. 3. The collection of personal data before informing consumers about necessary costs and obtaining consent violates consumer privacy rights. Section 3. Purpose The purpose of this Act is to ensure transparency in software pricing and protect consumer data by requiring upfront cost disclosure and limiting data collection practices. Section 4. Requirements for App Stores and Software Developers 1. Pricing Disclosure: a. App stores and developers must disclose all mandatory costs, including memberships, subscription rates, and one-time purchases, in app descriptions before download. b. Disclosures must include exact prices, subscription durations, and recurring costs. 2. Data Collection Restrictions: a. Apps may not collect personal data until the user is informed of and agrees to any mandatory costs. b. Data collection is limited to paid members unless explicitly consented to by the user. 3. Penalties for Noncompliance: a. Noncompliance may result in fines and potential removal from app stores. Section 5. Enforcement The Federal Trade Commission (FTC) shall enforce this Act and issue necessary regulations.
