I am writing today to express my deep concern over the Bureau of Alcohol, Tobacco, Firearms and Explosives’ recent rule changes and general behavior. In addition to concerns about their regulatory authority regarding ‘Factoring Criteria For Firearms With Attached “Stabilizing Braces”’, and their ability to define short barreled rifles outside of the purview of the National Firearms Act, I have also come across information on their website that seems to have no factual basis on the law. As it pertains to their stabilizing brace decision, the National Firearms Act currently defines a short barreled rifle with a barrel under 16 inches in length, or an overall length under 26 inches. The additional criteria that the ATF wants to consider includes configuration, optics, weight, length of pull, as well as a variety of other factors not specifically listed in the National Firearms Act. Much of what is being attempted by the ATF seems analogous to the EPA’s efforts as challenged in West Virginia V. EPA. I cannot imagine this decision would pass the “Major Questions Doctrine” pertaining to agency statutory authorization by congress. There is no explicit mandate from congress requesting these changes, and ultimately, I believe these decisions should be reversed. Regarding my comment about information from the ATF having no basis on the law, currently under their eform FAQ section, a question is posed stating: “Q. If I am the registered owner of a NFA item, can someone else shoot my item in my presence? No. Only Responsible Person(s) listed on the approved registration may have physical or constructive possession of the NFA item.” As far as I am aware, there is not a single place in the National Firearms Act, or the Gun Control Act that would prohibit the lending of NFA items while in the presence of the owner. I believe this information to be not only false, but a concerted effort to intimidate new NFA item owners, and reduce the further proliferation of these items. I would greatly appreciate you looking into this matter I would also appreciate your support for any bill, injunction, or congressional action that may limit or remove any regulatory authority from the ATF. These decisions will most likely be determined in a court of law, but I would ask that you not idly stand by while the ATF continues to diminish the rights of US citizens.
