Urgent Oversight Needed: DOGE’s Evasion of Accountability and Violation of Inherently Governmental Principles I am urgently requesting congressional investigation and legislative action regarding the Department of Government Efficiency (DOGE) and the involvement of Elon Musk in its operations. DOGE represents an alarming breach of democratic norms and federal law. Despite being granted extraordinary influence over government restructuring, personnel decisions, and budgetary actions, DOGE and its operatives—led or advised by Elon Musk—continue to claim they are merely “a group of advisors”, not an official federal agency. This intentional ambiguity is not just misleading; it is a deliberate tactic to evade transparency, accountability, and the legal constraints that bind actual government institutions. DOGE’s Actions Violate the Legal Boundaries of Inherently Governmental Functions Federal law—specifically OMB Circular A-76 and FAR Subpart 7.5—clearly outlines that inherently governmental functions must be performed by federal employees, not private citizens or contractors. These include, but are not limited to: • Determining and executing public policy • Commanding government personnel or making hiring and firing decisions • Overseeing budget formulation and resource allocation • Directing intelligence or law enforcement operations • Making decisions that bind the government to contractual or legal obligations DOGE has reportedly engaged in all of these functions, often without any formal documentation, public justification, or legal authority. This is not reform. This is privatized governance by stealth. DOGE’s claim of being “just advisors” is a legal smokescreen. The same individuals who claim they are outside the government are simultaneously making decisions that affect the lives, employment, and rights of millions of federal workers and citizens. This is unconstitutional and undermines the basic framework of representative government. Immediate Action Needed I respectfully urge Congress to: 1. Hold public hearings on the legal status, funding, and actions of DOGE, including Elon Musk’s role and any conflicts of interest. 2. Demand full disclosure of communications, directives, and memoranda issued by DOGE under FOIA—regardless of DOGE’s claims of non-agency status. 3. Reaffirm legal protections for inherently governmental functions and ensure that no individual or private entity is allowed to usurp them. 4. Establish guardrails to prevent future abuse by individuals acting under vague or unofficial authority while executing binding decisions for the federal government. We are at a constitutional tipping point. When unelected billionaires can operate in government shadows, claim they are “not the government” when convenient, and still direct federal workforce and resource decisions, we no longer have a government “of the people.” We have a hostile corporate takeover in progress. Act now before this becomes the new normal.
