The Rule of Law Is Under Attack—The Court Must Act or Step Aside Message to the U.S. Supreme Court: On May 9, 2025, members of Congress—Reps. Bonnie Watson Coleman, Robert Menendez Jr., and LaMonica McIver—were denied access to an ICE detention facility during a constitutionally protected oversight visit. Newark Mayor Ras Baraka was arrested for standing with them. This is not a bureaucratic miscommunication—it is a deliberate act of obstruction. And it is not isolated. This is part of a broader pattern of constitutional violations and executive overreach by the Trump administration. Legal authorities violated include: • Article I, Section 1 – Legislative oversight power • Article I, Section 6 – Speech or Debate Clause, protecting lawmakers from interference • 18 U.S.C. § 1505 – Obstruction of proceedings before Congress • 5 U.S.C. § 2954 – Agency obligation to provide information to the House • ICE’s own internal policy permitting oversight visits: https://www.ice.gov/doclib/detention/iceFacilityVisitationCongressional.pdf Meanwhile, the administration: • Is threatening to suspend habeas corpus without Congressional authority—Article I, Section 9 • Is misusing the Alien Enemies Act absent a declaration of war—Article I, Section 8 • Is enabling racially discriminatory asylum policy, privileging white Afrikaner migrants under false “genocide” claims promoted by Trump adviser Elon Musk, while denying basic due process to non-white asylum seekers. This is systemic lawlessness. And it is the Supreme Court’s solemn duty to stop it. As justices sworn to “support and defend the Constitution of the United States,” you must uphold the rule of law—not accommodate its slow destruction. The judiciary is the last safeguard between democracy and tyranny. We call on the Court to: • Immediately intervene to protect congressional authority and due process rights • Enjoin further executive attempts to suspend habeas corpus or obstruct legislative oversight • Affirm the limits of the Alien Enemies Act and enforce Article I powers • And if necessary, remind the nation that no president is above the law If the Supreme Court remains silent, it will have abdicated its constitutional role and become complicit in dismantling the very system it was created to preserve. Act now. Or history will record your inaction as the Court that surrendered to tyranny.
