Demand for Consumer Justice Regarding Unconstitutional Tariff Refunds

​I am writing to express my outrage regarding the implementation of the tariff refund process following the Supreme Court’s ruling that the IEEPA tariffs were imposed without constitutional authority. ​As of April 20, 2026, the U.S. Customs and Border Protection (CBP) has opened a portal for corporations to claim an estimated $166 billion in refunds. While I understand the legal necessity of returning funds collected under an unconstitutional policy, I am deeply concerned that the current system prioritizes corporate profits over the economic well-being of the American people. ​Economic data from the Federal Reserve and independent analysts has shown that the vast majority of these tariff costs were passed directly to consumers through higher prices at grocery stores, car dealerships, and retail outlets. Now that these taxes have been ruled illegal, the government is handing billions of dollars back to the very corporations that already protected their bottom lines by raising prices on us. ​Under the current framework, businesses are not legally required to pass these refunds back to the customers who actually bore the financial burden. This effectively allows corporations to "double dip"—first by collecting higher prices from the public, and now by receiving a massive windfall from the federal treasury. This is not just a policy failure; it is a massive, government-sanctioned redistribution of wealth from the working class to corporate shareholders. ​I am calling on your office to: ​Legislate Pass-Through Requirements: Introduce or support legislation requiring companies that receive these refunds to provide a verifiable plan for how they will compensate their customers or lower prices. ​Establish a Consumer Relief Fund: If direct refunds to every individual are deemed too complex, the interest or a portion of these "windfall" refunds should be redirected into a fund that directly benefits the public, such as inflation relief or infrastructure. ​Investigate Price Gouging: Ensure that companies receiving these refunds are not maintaining the "tariff-inflated" prices even after the taxes have been struck down and refunded. ​The government exists to protect the interests of the people, not just the balance sheets of multinational importers. I look forward to hearing how you plan to ensure that the American taxpayer is not left holding the bill for an unconstitutional tax while corporations walk away with a multi-billion dollar bonus.
