Advances in artificial intelligence have made it possible for anyone to create a convincing replica of another person’s voice or likeness, without their permission. These AI-generated deepfakes can be used in harmful ways, including financial scams (https://www.cbsnews.com/chicago/news/ai-deepfakes-scams-social-engineering-laws/), identity theft (https://www.cbsnews.com/news/deep-fakes-ai-tools-scammers-identity-theft-cybersecurity/), and the exploitation of artists, performers, and other creators (https://www.cnbc.com/2025/10/22/ai-deepfakes-music-artists-careers-martina-mcbride.html). The bipartisan NO FAKES Act of 2026 (S. 4591 (https://www.congress.gov/bill/119th-congress/senate-bill/4591) and H.R. 8915 (https://www.congress.gov/bill/119th-congress/house-bill/8915)) would establish a federal right to control the use of your own voice and likeness in AI-generated content. The bill would establish clear legal protections against unauthorized digital replicas (https://salazar.house.gov/media/press-releases/salazar-dean-blackburn-coons-bipartisan-colleagues-reintroduce-no-fakes-act) while preserving important exceptions for news reporting, parody, criticism, and other First Amendment-protected speech. One of the bill’s significant provisions would create a streamlined notice-and-takedown process for unauthorized AI replicas. That means that an individual who finds their voice or likeness being used without consent could demand the prompt removal of that content, rather than being forced to pursue litigation and hire an attorney, which can be prohibitively expensive. The legislation would also establish liability for platforms and services (https://www.blackburn.senate.gov/2026/5/technology/blackburn-coons-salazar-dean-colleagues-introduce-revised-version-of-no-fakes-act) that knowingly facilitate the distribution of unauthorized digital replicas. Congress has an opportunity to establish national standards for protecting Americans from AI impersonation and deepfake abuse. With AI tools becoming increasingly powerful and accessible, it’s imperative that they take action now. Call your senators and representative and tell them to support the NO FAKES Act to protect Americans from unauthorized AI-generated replicas.
