Open Letter to the United States Congress Re: Ensuring Free and Equitable Access to Proof of Citizenship To the Members of Congress, We, the undersigned, write to express urgent concern regarding the increasing necessity for Americans to produce documentation proving their citizenship in order to fully participate in civic life and to avoid wrongful detention. Whereas federal immigration enforcement agencies, including Immigration and Customs Enforcement (ICE), Customs and Border Protection (CBP), and the Department of Homeland Security (DHS), have expanded their presence within communities, raising concerns about the potential detention of individuals without immediate access to documentation verifying citizenship; Whereas the primary documents recognized as definitive proof of United States citizenship—namely, a valid U.S. passport or a certified birth certificate—are not equally accessible to all citizens, with birth certificates often existing as fragile paper records that may be lost, damaged, or difficult to obtain; Whereas pending and proposed legislation in Congress seeks to require documentary proof of citizenship to exercise the fundamental right to vote, including government-issued photo identification in combination with a birth certificate or a valid passport; Whereas these combined realities risk creating a system in which access to essential rights—such as voting and freedom from unlawful detention—may depend on an individual’s ability to obtain and maintain costly or difficult-to-replace documentation; Therefore, we call upon Congress to take immediate action to ensure that all citizens have equitable and barrier-free access to proof of citizenship. Specifically, we urge the following: That United States passports be made available free of charge to all citizens, removing financial barriers to obtaining this critical document; That the application and renewal processes for passports be simplified and made more accessible, particularly for low-income, rural, elderly, and marginalized populations; That Congress ensure no citizen is denied their constitutional rights due to inability to afford or access documentation; That safeguards be implemented to prevent the misuse of documentation requirements in ways that could infringe upon civil liberties. In a nation founded on the principles of liberty, equality, and justice, access to one’s rights must not be contingent upon one’s ability to pay for documentation. If proof of citizenship is to be required for participation in civic life or protection from detention, then it is the responsibility of the federal government to ensure that such proof is universally accessible.
