I am writing as your constituent to express my strong opposition to H.R. 9495, particularly the provisions that would grant the Treasury Department unilateral authority to revoke non-profit organizations' tax-exempt status.
While I understand the bill's intent to address serious concerns, the current language poses significant risks to legitimate non-profit organizations. The bill would allow the Treasury Secretary to designate organizations as "terrorist supporting" and strip their tax-exempt status without adequate due process protections. This power could have devastating consequences for non-profits, as losing tax-exempt status would be financially catastrophic for many organizations.
Of particular concern is that these determinations could be influenced by political considerations rather than objective criteria. The bill's broad scope could potentially chill constitutionally protected speech and advocacy work. It's worth noting that existing criminal laws already prohibit material support to terrorist organizations, with appropriate due process safeguards in place.
While I do not oppose the bill's provisions regarding tax relief for American hostages held abroad, I urge you to reject or substantially modify the sections pertaining to non-profit organizations. Any legislation addressing these serious matters should include robust due process protections and clear, objective criteria for enforcement.
