You Didn’t Rule It Was Legal. You Let It Happen Anyway. History Is Watching.

To the Supreme Court of the United States, Today, ten weeks before a midterm election, six of you voted along party lines to allow a president to decide who gets to vote by mail in America. You did not rule it was legal. You did not rule it was constitutional. Justice Sotomayor said so herself in her dissent: today’s decision does not suggest the executive branch has any constitutional authority to do this. You simply let it happen anyway. One in three Americans voted by mail in 2024. Military families. Elderly citizens. Disabled Americans. Rural voters. People who cannot stand in line for hours because they are working two jobs to survive in the economy this administration has created. The president whose order you just unleashed voted by mail himself — in Florida — earlier this year. You know what this order does. It creates a federal list of who is allowed to vote. It instructs the Post Office to deliver ballots only to those the government approves. It threatens states with the loss of federal funding if they do not comply. It was challenged by 23 states and Washington D.C. It was blocked by a federal judge who understood what it was. And you lifted that block. Unsigned. Ten weeks before an election. Using the same shadow docket that your Chief Justice invented in 2016 to avoid accountability, oral arguments, and the inconvenience of explaining yourselves to the American people. You are not protecting democracy. You are dismantling it — in robes, with marble columns behind you, in language so careful and hedged that you can pretend your hands are clean. They are not clean. History is being written right now. Your names are in it. The three justices who dissented will be remembered for their courage. The six who voted to let a president choose his voters ten weeks before an election will be remembered too. We see you. All of you. And so will history.
