Prosecute Kash Patel for Perjury Before Senate Judiciary Committee
To: Rep. Maloy, Sen. Lee, Sen. Curtis
From: A constituent in Salt Lake City, UT
February 3
I am writing to urge you to support the immediate prosecution of FBI Director Kash Patel for perjury committed during his Senate confirmation hearing before the Judiciary Committee.
Senator Dick Durbin has presented credible evidence from multiple sources indicating that Patel, while still a private citizen awaiting confirmation, personally directed the removal of career civil servants at the FBI. These directives were allegedly carried out through White House Deputy Chief of Staff Stephen Miller and Acting Deputy Attorney General Emil Bove. Notes from a January 29 meeting involving acting FBI director Brian Driscoll reportedly read "KP wants movement at FBI, reciprocal actions for DOJ," and Bove allegedly stated he received calls from Miller about Patel wanting faster removal of targeted employees.
This directly contradicts Patel's sworn testimony when Senator Cory Booker asked if he was aware of plans to punish or terminate FBI personnel. Patel responded under oath: "I don't know what's going on right now over there." If the evidence is accurate, this constitutes perjury before Congress, a federal crime under 18 U.S.C. Section 1621 punishable by up to five years in prison.
Lying under oath to the United States Senate is not a minor offense. It strikes at the heart of our constitutional system of checks and balances. The confirmation process exists to ensure that nominees are truthful and qualified. When someone lies to obtain Senate confirmation for one of the most powerful law enforcement positions in the country, they must face the full consequences under the law.
I urge you to call on Justice Department Inspector General Michael E. Horowitz to complete his investigation and refer findings to prosecutors. Additionally, I ask that you publicly support criminal prosecution of Patel to the fullest extent of the law. Representative Dan Goldman has called for whistleblowers to submit affidavits, and these should be forwarded to appropriate law enforcement authorities.
No one, regardless of position, should be above the law. I ask that you take immediate action to hold Patel accountable for lying to Congress under oath.
