I am writing to urge your support for Senate Bill 5855, introduced by Senator Javier Valdez, which would prohibit law enforcement officers from wearing face-concealing masks while interacting with the public in Washington State. This legislation addresses a critical accountability gap that has emerged during recent immigration enforcement operations.
The bill responds directly to Immigration and Customs Enforcement agents wearing balaclavas, tactical masks, and other identity-concealing coverings during raids in our communities. When officers hide their faces, they create an environment where abuse becomes easier and accountability becomes nearly impossible. People have the fundamental right to know who is exercising government power over them, particularly during stops, questioning, or detention.
Senate Bill 5855 reinforces existing requirements under RCW 10.116.050 that officers be reasonably identifiable through clearly displayed names or identifying information. The legislation includes sensible exceptions for officers engaged in active undercover operations and SWAT officers using protective face gear necessary for tactical duties. It also permits clear face shields, medical masks, respirators in hazardous conditions, and transportation helmets.
Importantly, the bill creates a private right of action for individuals detained by officers violating this law, allowing them to seek compensation, attorney fees, and other appropriate remedies. This enforcement mechanism ensures the law has teeth and provides recourse for those whose rights are violated.
Anonymous policing erodes the trust between law enforcement and the communities they serve. When federal agents operate in our neighborhoods with covered faces, it creates fear and undermines the legitimacy of law enforcement itself. Our communities deserve transparency about who is exercising authority in their streets.
The bill is expected to receive a hearing early in the 2026 legislative session in the Senate Law & Justice Committee. I ask that you support Senate Bill 5855 to establish clear accountability standards and protect both responsible officers and the public they serve.
