The NORRA of 2025 threatens to severely undermine the system of checks and balances that is vital to our democracy. By stripping federal district courts of their authority to provide injunctive relief against unconstitutional or unlawful actions by the executive branch, this bill would remove a crucial mechanism for holding the government accountable. Injunctive relief serves as an essential safeguard, ensuring that the rights and liberties of citizens are protected from overreach by any one branch of government. Granting sweeping powers to the executive without meaningful oversight would erode the separation of powers enshrined in our Constitution. The proposed three-judge panel process is inadequate, as it still imposes arbitrary limitations and fails to provide a robust system of judicial review. Furthermore, allowing nationwide injunctions only in cases brought by multiple states presents a concerning barrier to protecting the rights of individuals and organizations. I implore you to reject this legislation, as it poses a grave threat to our democratic principles and the rule of law. Preserving the authority of federal courts to issue injunctive relief is paramount to maintaining a healthy system of checks and balances, and ensuring that the government remains accountable to the people it serves.
