As your constituent, and a voter concerned about the current levels of cronyism and self-dealing in our nation's capital, I write to urge your support for the FCPA Statute of Limitations Extension Act, a bill currently pending but not yet assigned to committee that would extend the statute of limitations for violations of the Foreign Corrupt Practices Act (FCPA) from five years to ten years. As you know, an Executive Order issued in February 2025 paused initiation of new DOJ FCPA investigations pending review. The DOJ did subsequently lift the enforcement pause when it issued new FCPA guidelines in June 2025, however those new guidelines substantially narrowed enforcement priorities and, according to legal practitioners’ reports, led to a material reduction in new DOJ filings and the closure or early termination of a number of prior inquiries and corporate resolutions. Given this pause in enforcement, the five‑year statute of limitations in the current FCPA is too short for complex, multinational bribery cases that require cross‑border discovery, cooperation with foreign authorities, forensic accounting, and in‑depth corporate remediation assessments; the near‑term reduction in DOJ enforcement after the EO and guidelines has demonstrably reduced immediate enforcement risk, lowering deterrence and increasing opportunities for self‑dealing, cronyism, and illicit enrichment. Extending the statute of limitations to ten years would (a) align statutory exposure with practical investigative timelines, (b) restore prosecutorial leverage when new evidence emerges after lengthy international cooperation, and (c) mitigate the adverse effect of any temporary enforcement slowdowns. I respectfully ask you to: Support and co‑sponsor the FCPA Statute of Limitations Extension Act to extend the FCPA statute of limitations from five to ten years. Advocate for expedited committee assignment and floor consideration so that the enforcement gap created by the 2025 pause cannot be exploited with impunity. Thank you for your consideration.
