An Open Letter

I write with grave concern about the Trump administration’s ongoing violations of the Constitution and its unlawful use of executive power. On May 2, 2025, U.S. District Judge Fernando Rodriguez ruled that the administration’s deportation order under the Alien Enemies Act was unconstitutional. There is no war, no invasion, and no lawful basis to invoke a wartime statute against noncitizens based on vague or unproven affiliations. This is not national defense—it is racialized political targeting. Now the administration is threatening to suspend habeas corpus—a constitutional safeguard meant to prevent indefinite detention without trial. Article I, Section 9 of the Constitution explicitly restricts suspension to cases of rebellion or invasion, and only Congress has that authority. This threat is a direct assault on the most sacred protections of liberty. Simultaneously, the administration is welcoming white Afrikaner refugees from South Africa under a false narrative of racial persecution, while detaining and deporting thousands of Black and Brown asylum seekers without due process. Even U.S. intelligence agencies and the South African government have debunked the administration’s claims. Elon Musk, a Trump adviser raised in apartheid-era South Africa, has actively spread false “white genocide” propaganda to justify this grotesque double standard. This Court has a constitutional duty to act—not defer—when executive power threatens the liberties of the people. The Constitution cannot defend itself. If the judiciary fails to check these abuses, then we have abandoned our founding principles. Uphold the rule of law. Protect habeas corpus. Restore due process. And if necessary, affirm that no official is above the law—not even the president. The oath to uphold the Constitution is not symbolic. It is binding. If this administration will not obey the law, then it must be impeached, removed, and prosecuted for its violations of civil rights and constitutional order. The world is watching. So are we.
