An Open Letter

I am writing as a constituent to ask you to support federal legislation establishing fair, consistent rules for congressional redistricting. This is not a request to advantage either party. It is a request to make elections more competitive, communities more fairly represented, and politicians more accountable to voters. Article I gives Congress authority to regulate the manner of congressional elections. In Rucho v. Common Cause, the Supreme Court held that federal courts cannot resolve partisan-gerrymandering claims, while recognizing that Congress can address the problem. When the courts cannot set a workable national limit, Congress should exercise its constitutional responsibility. The current cycle of mid-decade map changes shows why action is needed. When one party redraws districts to gain seats, the other faces pressure to retaliate. That arms race can leave voters with oddly shaped districts, split communities, and election outcomes that are insulated from changing public opinion. It also wastes public resources on repeated elections and litigation. I urge you to support legislation that applies equally in every state and to both parties. It should generally permit congressional maps to be redrawn only after the census, require transparent public hearings and meaningful community input, and establish independent commissions or another genuinely nonpartisan process. It should set clear, enforceable criteria: districts must be contiguous and reasonably compact; preserve counties, municipalities, and communities of interest where practicable; comply with the Constitution and Voting Rights Act; and prohibit drawing maps to favor a party or protect incumbents. Provide timely judicial review and federal assistance so states can meet the rules. A commission alone is not enough. Its membership, selection process, disclosure requirements, and decision rules must prevent either party from controlling the outcome. Objective criteria and public scrutiny matter as much as who draws the lines. These reforms need not dictate which party wins or guarantee proportional representation. They can instead give voters a fair chance to choose their representatives, while protecting minority voters’ opportunity to participate and elect candidates of their choice. Research on redistricting reforms has found that stronger constraints on partisan mapmakers can reduce partisan bias and improve competition. Please use Congress’s authority to advance bipartisan legislation that ends partisan gerrymandering and restores public confidence in congressional elections. Voters should choose their representatives, not have their choices engineered by them.
