I am writing in regards to the budget that recently passed the House.
Buried within the bill, on pages 562 and 563, there is an issue totally unrelated to the budget! (I am appalled at the intent to hide something, so important AND unrelated to the budget, from the American public/voters!)
This section would require individuals or groups, suing the government, to FIRST post a bond, before a court could enforce an injunction or temporary restraining order! This would restrict the courts from enforcing contempt citations for violations!
Under the current practice, judges often waive bond requirements, especially in public interest litigation. Additionally, the provision would apply RETROACTIVELY, impacting existing court orders! This law would undermine judicial authority, effectively shielding the government from legal challenges, particularly in cases where the government is accused of unconstitutional conduct!
This section MUST be removed from the budget reconciliation bill and I urge you to make every effort to do so!
