An Open Letter

To: Sen. Ernst, Sen. Grassley

From: A constituent in Cedar Rapids, IA

January 29

Oversight Needed After FBI Search of Georgia Election Records I am writing as a Iowa constituent to express serious concern about the recent execution of a court-authorized FBI search warrant at the Fulton County, Georgia election office seeking 2020 election ballots, tabulator tapes, ballot images, and voter rolls. This operation has alarmed local officials and election integrity advocates, particularly because those materials were under county custody and have since left state control. Although the warrant was signed by a judge, the context in which this action occurred heightens constitutional and democratic concerns. The raid follows repeated baseless claims of widespread fraud in the 2020 election, despite multiple audits and court decisions confirming the results. It also arrives amid broader debates about the appropriate role of federal authorities in state-run election processes. Regardless of partisan views about past elections, the integrity of our electoral system depends on clear boundaries between federal authority and state election administration. Federal action involving ballots and voter rolls — particularly materials long certified and repeatedly verified — must be transparent, justified under law, and subject to robust oversight to avoid perception of political weaponization of federal law enforcement. I urge you to support immediate congressional oversight of this incident. Specifically: • Will you support public hearings to examine the legal basis, scope, and safeguards around federal access to state election materials? • Will you back requests or subpoenas for all documentation related to the warrant, DOJ justifications, and chain of custody for seized ballots and records? • Will you advocate for statutory limits on federal seizure of state election records unless there is a compelling, clearly demonstrated threat to election integrity? Maintaining public confidence in elections is foundational to democracy. Congress must ensure that extraordinary federal actions are subject to transparency, accountability, and respect for the constitutional role of state election officials.
