Abolish the unconstitutional Ohio House Bill 245

I am writing to you today with deep, serious concerns over your proposed amendments to sections 2907.39 and 4301.25 of the Ohio Revised Code, also known as Ohio House Bill 245. As written, the language in this bill could be abused in a way that would disproportionately and negatively affect the already marginalized transgender community, with serious repercussions. The bill is being presented as a ban on drag performances, but the issue I am raising is specifically with the following language: (Sec. 2907-39-A-4) Specifically, “performers or entertainers who exhibit a gender identity that is different from the performer's or entertainer's gender assigned at birth using clothing, makeup, prosthetic or imitation genitals or breasts, or other physical markers; or other similar performers or entertainers who provide entertainment that appeals to a prurient interest, regardless of whether or not the performance is for consideration.” The language in this amendment equates gender-diverse presentation with sexually explicit, adult content, which is an obscene concept in and of itself. Musicians, singers, poets, comedians, stage actors, ballet dancers, and more would be severely impacted by this legislation, and targeted with grossly unethical criminal punishments. It is a blatant violation of Ohians’ First Amendment rights. Section 2907-39-F-2 would equate a transgender artist performing in a public square with such crimes as grand theft auto, aggravated assault, even sexual misconduct with a minor. You are attempting to equate transgender existence with child rape. It is clear to most constituents that the current “culture war” against the transgender community is being driven by Christian extremists, who have interpreted the Christian Bible in a way that many Ohioans consider erroneous. These interpretations suggest that transgender people are committing some form of unforgivable sin against God, when in fact, there are many who believe that there is clear biblical evidence supporting the creation and inclusion of transgender people (Reference: https://youtu.be/k3d_mhbTwL4?si=UitmBWzW7Pc2LUsA). Once again, these “culture war” issues violate the First Amendment rights of Christian Ohioans who believe in a fully-affirming and inclusive Gospel. Under no circumstances should this law be put into effect. I very seriously demand that this body no longer p ursue such a harmful and discriminatory amendment.
