I am writing regarding the hearing held by the House Judiciary Subcommittee on the Constitution and Limited Government, scheduled on Wednesday, September 2, 2026. The hearing is titled “‘Subject to the Jurisdiction Thereof’: Birthright Citizenship and the Fourteenth Amendment, Part II” and is intended as a forum for possible legislative responses to the recent Supreme Court decision re-affirming birthright citizenship as it has been understood since the 14th Amendment was passed. As your constituent, I urge you to support the only acceptable legislative response: legislation reaffirming the existing constitutional and statutory rule that nearly every person born in the United States is a U.S. citizen at birth, regardless of the immigration status of the their parents, subject only to the narrow, historically recognized exceptions. Congress should not enact schemes designed to exclude U.S. born children from citizenship because their parents are undocumented or temporarily present in the country. Such a measure would undermine the Fourteenth Amendment’s Citizenship Clause, create uncertainty for families and government agencies, and threaten the equal treatment of children born in the United States. Instead, Congress should provide clear statutory confirmation that birthright citizenship remains the law of the United States. Any such legislation should affirm citizenship for people born in the United States, confirm that a child’s citizenship does not depend on the parents’ immigration status, preserve only the traditional exceptions recognized under constitutional law, such as children of foreign diplomats, and ensure consistent administration by federal and state agencies. I respectfully ask you to support legislation reaffirming birthright citizenship and to oppose any proposal that would restrict or deny citizenship to U.S. born individuals based on their parents’ immigration status. Thank you for your attention to this important constitutional issue. Please let me know how you intend to approach the upcoming hearing and any related legislation.
