I’m writing to express outrage over S.996, Senator Mullin’s latest gift to the fossil fuel industry. Let’s be clear: this bill doesn’t protect “choice”—it protects profits for oil and gas companies by blocking states from setting stronger clean air standards. It’s a deliberate attack on states like California that have dared to lead on climate policy and consumer protections.
This bill would strip the EPA’s authority to grant waivers under the Clean Air Act—one of the most effective tools states have used to push automakers toward innovation and pollution reduction. Why? Because some politicians think their ideology matters more than our right to breathe clean air or buy an electric car that doesn’t choke our communities with emissions.
It’s hypocritical to scream about “states’ rights” and “freedom” only when it’s politically convenient. S.996 isn’t about liberty—it’s about locking in outdated technologies and locking out progress. Americans should be free to choose cleaner vehicles. And states should be free to lead where Congress refuses to.
