URGENT STATUTARY AND CONSTITUTIONAL REVIEW REQUEST: Defense Production Act Invocation Protecting Glyphosate Industry Poses Material Risk to Public Health, Regulatory Integrity, and National Security I am writing to demand immediate congressional oversight into the February 18, 2026 Executive Order invoking Section 101 of the Defense Production Act (50 U.S.C. § 4511) to prioritize and protect domestic production of elemental phosphorus and glyphosate-based herbicides. This order elevates glyphosate production to a matter of “national defense” and directs that agency action must not threaten the “corporate viability” of domestic producers. It further invokes immunity provisions under 50 U.S.C. § 4557. Robert F. Kennedy Jr. has publicly warned for years that glyphosate poses cancer risks and has participated in litigation against Monsanto over Roundup exposure. Now, as a federal official, he is aligned with an order that shields and prioritizes the same industry he previously accused of endangering Americans. This contradiction raises serious concerns: • Whether the statutory “scarce and critical” findings under 50 U.S.C. § 4511(b) are supported by evidence • Whether the “corporate viability” directive exceeds the intended scope of the Defense Production Act • Whether immunity protections are being used to distort civil accountability • Whether public health considerations have been subordinated to political or industrial interests Federal officials swear an oath to the Constitution and are obligated to protect the health and safety of the American people. National defense authorities must not be repurposed to insulate controversial chemical production from scrutiny. I urge you to: • Initiate immediate oversight hearings • Demand the full administrative and national security record underlying this Executive Order • Examine the scope and legal limits of the immunity provisions invoked • Investigate whether federal officials have failed in their duty to protect public health • Pursue all appropriate constitutional remedies, including censure or impeachment proceedings if warranted The Defense Production Act is an emergency national security statute. It must not be used as a political shield for industrial interests at the expense of regulatory integrity and public safety. I request a written response outlining the specific oversight actions you will take.
