The Unprecedented Erosion of Judicial Legitimacy via the Shadow Docket

The Supreme Court’s increasing reliance on the shadow docket—the use of emergency, non-merits orders to decide significant issues without the transparency of full briefing, oral arguments, or written opinions—has reached an alarming level that undermines the credibility of the judiciary. Recent data indicates a stark shift in the outcomes of these shadow docket applications. During the previous administration, rulings on these emergency applications were split approximately 50/50. Conversely, during the current term, approximately 90 percent of these shadow docket rulings have been decided in favor of the administration. This statistical disparity suggests a pattern that prioritizes specific political outcomes over consistent judicial process. The persistent use of this opaque mechanism is actively harming the American public in the following ways: 1. It bypasses the established procedural safeguards designed to ensure that the law is applied fairly and predictably. 2. It eliminates the requirement for the Court to provide reasoned, written opinions, effectively shielding the Justices from the accountability that transparency demands. 3. It fundamentally erodes public trust, as the Court appears to function less as an impartial arbiter of the law and more as an institution driven by partisan alignment. The legitimacy of the Supreme Court is not guaranteed; it is earned through its commitment to the rule of law and transparency. By continuing to bypass the traditional merits docket for high-stakes decisions, the Court is damaging its own institutional standing. I am adding my name to the record to demand that the Court acknowledge this damage and return to a transparent, reasoned process. You must understand that if the Court persists in using the shadow docket to issue unexplained, partisan-aligned rulings, the American people will be compelled to seek legislative remedies through Congress to mandate oversight and restore the balance of our democracy.
