I am writing as a constituent and as someone who provided sensitive personal information to the Transportation Security Administration to obtain TSA PreCheck certification. I supplied that information for a limited purpose: to undergo a security screening process and make air travel safer and more efficient. I did not consent to having my name, birth date, and travel information used to identify me or anyone else for immigration enforcement. I was therefore deeply troubled to learn that TSA information may be made available to Immigration and Customs Enforcement and used to facilitate airport arrests. This is a serious breach of the trust Americans must place in government when participation in a federal program requires disclosure of personal information. Data collected for one purpose should not quietly become an enforcement tool for another. Please support H.R. 10040, the No TSA Data for ICE Act. I also ask you to work to strengthen it. The bill should expressly prohibit TSA from disclosing covered information, require the deletion of information already transferred, and bar retention, copying, redisclosure, or use of records derived from it. It should cover passenger information obtained from airlines, reservation systems, airports, travel companies, and data brokers, and prevent access through other agencies, contractors, task forces, or similar applications. The bill should also include public reporting, inspector general audits, whistleblower protections, and a meaningful private right of action for people harmed by unlawful access or use. It should provide notice, appeal rights, and judicial review when Trusted Traveler participation is denied, suspended, or terminated, and clearly prohibit retaliation for lawful speech, protest, journalism, or advocacy. I also ask you to consider the contrast with the administration’s decision to delete beneficial ownership information collected under the Corporate Transparency Act. Treasury has said that data supplied by millions of Americans will be deleted because privacy and burden concerns outweigh its continued retention. Are privacy concerns taken seriously only when wealthy businesses want to conceal who owns them? Ordinary travelers also deserve limits on government data collection and use. Please protect the information I was required to provide, and support a clear legislative firewall between transportation security and immigration enforcement.
