Based on the evidence presented, Donald Trump should be disqualified from holding the office of President under Section 3 of the 14th Amendment due to his involvement in the January 6th insurrection. The unprecedented release of insurrectionists who violently attacked the Capitol on that day underscores the grave threat Trump posed to our democratic institutions and constitutional order. By spreading lies about election fraud and attempting to overturn legitimate election results, Trump engaged in an insurrection aimed at obstructing the peaceful transfer of power. Section 3 was adopted after the Civil War precisely to prevent such treasonous acts by disqualifying those who give aid or comfort to insurrections. Though the path ahead involves complex legal questions, allowing Trump to regain the presidency after fomenting a violent assault on the seat of our government would make a mockery of the 14th Amendment's noble purpose to safeguard democracy.
