The proposed legislation to implement equal protection for "the right to life of each born and preborn human person" under the 14th Amendment raises significant constitutional concerns. It seeks to grant legal personhood to fetuses, effectively banning abortion nationwide. This would strip away the reproductive rights affirmed by the Supreme Court in Roe v. Wade and subsequent cases. Women would lose the ability to make deeply personal decisions about their own bodies and futures. Equal protection and due process demand that women have autonomy over their pregnancies. Forced birth violates privacy, liberty, and gender equality. Countless personal situations make abortion access critically important, from fetal abnormalities to risk to the woman's life or health. This one-size-fits-all federal ban denies women's moral choice based on their own values and circumstances. It represents an unconstitutional overreach of government power into one of the most intimate spheres of human life.
