I write to you as a citizen gravely alarmed by the recent actions of the Executive Branch, which have pushed this country to the brink of unlawful war. President Trump’s unilateral military strikes against Iran—carried out without Congressional authorization—are in direct violation of the Constitution and the War Powers Resolution. If unchecked, they signal the collapse of the separation of powers and the erosion of the most basic democratic safeguards. The Constitution is clear: only Congress may declare war. No president, regardless of party or popularity, has the authority to bypass that requirement. These recent actions not only defy that mandate but also expose millions of Americans—and countless others abroad—to the devastation of a war they did not consent to and which has no legal justification. It is your duty to defend the Constitution, not just in theory but in practice. The Court must not remain silent while the Executive arrogates powers it does not possess. Your past rulings have established limits on presidential authority—those limits must mean something now, when the stakes are highest. I urge the Court to prepare to hear any challenge brought before it regarding the legality of these actions. Furthermore, I implore you to affirm, through action or statement, that constitutional war powers reside with Congress, not the President alone. Without clear and immediate reinforcement of this principle, the very foundation of our system—checks and balances—begins to unravel. This is not just a legal issue. It is a moral one. And it is urgent. The American people are watching. History is watching. You must uphold your oath and act to protect the rule of law before it is too late.
