The proposed legislation HB2391 seeks to codify a narrow biological definition of sex based solely on reproductive function, disregarding the complexities of human gender identity and expression. Such a reductive approach raises significant concerns about discrimination and infringement on the rights of transgender and intersex individuals. It fails to account for the reality that gender exists on a spectrum and cannot be neatly categorized into binary terms. Rather than promoting safety and privacy, this bill risks ostracizing already marginalized groups and embedding regressive societal attitudes into law. A more inclusive, science-based understanding of gender is needed to uphold human dignity and equal protection for all citizens, regardless of gender identity or expression.
