The proposed legislation HB2391 seeks to codify a narrow biological definition of sex based solely on reproductive function, disregarding the complexities of human gender identity and expression. Such a reductive approach raises significant concerns about discrimination and infringement on the rights of transgender and intersex individuals. It fails to account for the reality that gender exists on a spectrum and cannot be neatly categorized into binary terms.
