I’m writing this letter to voice my strong concerns as a constituent to oppose S. 5260, the Interstate Obscenity Definition Act (IODA), an extremely dangerous bill that would federally ban all forms of pornography in the U.S. This bill will not only endanger the porn culture, it also endangers free speech and expression of millions of Americans who are Fanfiction writers, artists, sex workers, and even SA survivors who want to share their stories. It will also overturn the 1973 Supreme Court decision; The Miller test, so that the co-sponsor can change the definition of “obscene” and label, not only porn, but books, video games, anime, and literally anything they personally don’t like (including abortion and LGBTQ+ people) as obscene. Our rights to create and post our explicit work online is unfortunately not protected by the First Amendment. This bill perfectly aligns with Project 2025 written by right-wing extremists that want to label anything LGBTQ+ as “pornographic”, no matter if it’s child friendly or not. Not only I oppose IODA, I oppose it with strong prejudice because as the other bad internet bills like the Kids Online Safety Act (KOSA) and the SCREEN Act, it’s gonna bring more harm to people rather than protecting them. The ones who are supporting this don’t seem to care about the negative consequences and only care about controlling what we can or can not say or do on the internet. As we know from history, obscenity laws like IODA will not do anything good, especially for LGBTQ+ people.
