Subject ICE Funding and Constitutional Limits
I am writing to express concern regarding proposals to significantly expand ICE funding and detention capacity.
Current proposals would allocate approximately $77 billion to immigration enforcement, despite unlawful presence generally being a civil violation and, in limited cases, a misdemeanor under federal law. From both a fiscal and proportionality standpoint, this level of spending merits close scrutiny. Of particular concern is the planned expansion of detention capacity to roughly 150,000 beds, which raises questions about the legal basis, scope, and oversight of detention at that scale.
If Congress determines that ICE should continue operating at its current scope, then enforcement standards should be strengthened to ensure transparency and constitutional compliance. At a minimum, I urge consideration of the following:
* Clear name and badge identification for all officers
* Prohibition of face coverings during routine enforcement actions
* Standardized, recognizable civilian law-enforcement uniforms
* Reliance on judicial warrants consistent with the Fourth Amendment rather than administrative warrants
These measures would support lawful enforcement while reinforcing public trust and constitutional safeguards.
I am also concerned by recent statements suggesting federal control of elections. Article I, Section 4 of the Constitution assigns election administration to the states, subject to limited congressional authority. Such remarks warrant a clear reaffirmation of constitutional limits by Congress.
You took an oath to support and defend the Constitution. I respectfully ask that you uphold that commitment through careful oversight of enforcement policy and by defending the federalist structure established by the Constitution.
