Improve Due Process Protections in Anti-Terrorism Tax Bill
To: Rep. Kean
From: A constituent in Hopatcong, NJ
November 20
I understand the important issues this bill aims to address, such as supporting American hostages abroad and combating terrorist financing. However, there are significant concerns about potential overreach and unintended consequences that warrant careful consideration. While assisting unlawfully detained Americans is a worthy goal, automatically postponing tax deadlines and reimbursing penalties for any "unlawfully or wrongfully detained" individual sets an ambiguous standard that could be exploited. There needs to be a clear, objective process for determining who qualifies to prevent abuse. The provisions terminating tax-exempt status for organizations deemed "terrorist supporting" also raise due process concerns. The designation criteria and process seem overly broad, lacking robust evidentiary requirements and appeals mechanisms. This could enable discriminatory targeting of legal advocacy groups based on tenuous connections. I urge you to oppose this bill unless it is substantially amended to include stronger due process protections, narrower definitions aligning with established legal standards, and robust oversight mechanisms. Protecting civil liberties and ensuring fair, unbiased enforcement should be prioritized alongside the stated objectives.
