ICE Out: Do Not Participate In Inhumane & Unconstitutional Deportation Practices

To: Gov. DeWine, Sen. Hicks-Hudson, Rep. Grim

From: A constituent in Toledo, OH

February 2

In 1803, a landmark decision was reached in the case of Marsbury vs. Maddison, establishing the principal that it is the courts' duty to work against laws they deem unconstitutional. In a decision filed January 31st of this year, Federal Judge Fred Biery delievered a righteous condemnation of federal Immigration and Customs Enforcement's brazen disregard for the laws of this land as he ordered Adrian Conejo Arias and his son to be sent home. "The case has its genesis in the ill-conceived and incompetently-implemented government pursuit of daily deportation quotas, apparently even if it requires traumatizing children," the Judge writes, contrasted with the courts' slow but legal method of ensuring only those who have actually commited violations and aren't needed for further court processes are deported. "Apparent also is the government's ignorance of an American historical document called the Declaration of Independence." The Judge goes on to compare ICE's actions to those that set off the American Revolutionary War: namely those that have to do with sending large quantities of troops to patrol the streets of otherwise peaceful cities. Furthermore, he finds that ICE repeatedly violates the 4th amendment of the Constitution of the United States with their "administrative warrants". He does not comment on ICE's alleged history of rounding up groups of people from their workplaces or from running errands, but those actions, captured on numerous videos, are even less constitutional. The decision summarizes itself thus: "Ultimately, Petitioners may, because of the arcane United States immigration system, return to their home country, involuntarily or by self-deportation. But that result should occur through a more orderly and humane policy than currently in place." ICE's inhumane and unlawful actions should not be allowed on Ohio streets. Until such a time as they have been restructured into a law-abiding organization, complete with accountability in the form of removing face masks and providing ID like any police officer or federal agent has to, I urge my government to deny federal "assistance" in what has been largely an administrative violation, and allow our immigrant neighbors who have suddenly found themselves in a bureaucratic faux pas the time to see their dates in court before they are sent to some detention facility. I also urge for a commitment to applying the 4th amendment of the United States Constitution to ICE facilities & activities and common sense reforms like the ability to hold federal agents accountable through the courts. Finally, I urge you to follow along with many state governments in banning the building of any federal detention centers, or allowing Ohio tax dollars to be spent where the federal government overlooks their own bills.
