Cox vs Sony - please don’t put US households at the mercy of allegations

To: Justices Court

From: A constituent in Rancho Santa Margarita, CA

December 2

In regard to the upcoming Cox Communications v. Sony Music Entertainment case, I am asking you to oppose Sony Music Entertainment's claim that copyright enforcement is the responsibility of the internet provider, when it used to be that it was only their responsibility if they actively encouraged it. If this was allowed, then it would push internet providers to cut a person's connection at the merest hint of copyright violation. And that can easily be faked with bots. This will not make things better for anyone - if anything, it might lead to the death of the internet itself. Wish I was being dramatic but no. YouTubers especially can attest to how broken and sometimes malicious bot systems are and how they ruin entire livelihoods with no easy fix. I’m a writer with a vested interest in not allowing corporations to abuse their power against artists and creatives, and I would not choose to punish Cox on this case - that’s how disturbing the far-reaching implications of this could be. A precedent here that third parties involved are responsible for crime, in this political landscape, would be weaponized like crazy. We are looking at a potential legal landscape where billionaires can pull the plug on your whole house for allegations in order to avoid a lawsuit. Before section 230 social media companies were getting sued for all kinds of nonsense reasons by political extremists or people who just hated them. Driving them to bankruptcy and forcing them to censor just, whatever. I can’t imagine the kind of damage that would start up if people knew you could get someone fired and cut off from their friends and family with a simple copyright claim - and have you seen what gets deleted by copyright claims these days, in situations that take weeks even months to resolve!? If ever? Parodies no one could possibly mistake for the original... fangames making no money that openly and frequently proclaim that they do not own the characters or anything therin, and do everything possible to abide by the rules of the specific companies they are fans of… so much more. And by so many bots that can even confirm each others decisions without a single intelligent thought. Similar systems can’t even determine mature content correctly. And large supposed to be reputable companies have shown extreme willingness to keep using faulty systems instead of human review for their customer service issues even upon request. YouTube is currently ignoring a vast amount of creators without even ordering their bots to tell them exactly what they did wrong. Imagine having your internet cut off one day and just radio silence from your provider! There are not enough ethical managers or enough laws to govern this situation against the inevitable bad faith actors and tech malfunctions. Please, rule against Sony Music Entertainment. I cant believe I’m asking this but I simply have to.The alternative is just catastrophic.
