Investigate Elon Musk Urgently

To: Sen. Budd, Rep. Foushee, Sen. Tillis

From: A constituent in Apex, NC

February 24, 2025

I am writing to express my deep concern about the unchecked influence of Elon Musk and his ventures, particularly his recent involvement in federal government operations through the Department of Government Efficiency (DOGE). His actions raise significant ethical, legal, and constitutional issues that necessitate immediate congressional oversight. 1. Unconstitutional Exercise of Power: Elon Musk has been granted extensive authority over federal agencies without Senate confirmation, as required by the Appointments Clause of the U.S. Constitution. This unprecedented delegation of power has prompted a coalition of 14 state attorneys general to file a lawsuit challenging the legality of his role. 2. Violation of Federal Employment Laws: Musk issued a directive demanding all federal employees justify their positions by listing their weekly accomplishments, under threat of termination. This action has been criticized as illegal and coercive, violating civil service protections and union agreements. 3. Conflicts of Interest and Misuse of Data: Through DOGE, Musk has gained access to sensitive federal data, raising concerns about potential misuse to benefit his private enterprises, such as Tesla and SpaceX, both of which have substantial federal contracts. This dual role creates a significant conflict of interest and poses risks to individual privacy and corporate competitiveness. 4. Legal Violations in Securities Reporting: The Securities and Exchange Commission (SEC) has charged Musk with failing to timely file a beneficial ownership report after acquiring more than five percent of Twitter's shares. This delay allegedly allowed him to purchase additional shares at artificially low prices, resulting in significant financial gains at the expense of other investors. 5. Federal Contracting Concerns: Despite advocating for reduced federal spending, Musk's companies have received substantial federal contracts, totaling at least $18 billion over the past decade. This contradiction highlights potential self-serving motives and underscores the need for scrutiny of his influence over federal expenditures. Given these serious issues, I urge Congress to take immediate action to: Investigate the legality and constitutionality of Elon Musk's role within DOGE and his influence over federal agencies. Assess potential conflicts of interest arising from his access to sensitive federal data and the substantial federal contracts awarded to his companies. Establish clear regulatory frameworks to prevent the misuse of authority by unelected individuals in federal positions. The American people deserve transparency, accountability, and protection against the overreach of power by influential individuals. I urge you to address these concerns promptly to safeguard our democratic institutions and public trust. Thank you for your attention to this matter. I look forward to your response and any updates on legislative efforts to ensure appropriate oversight.
