Gas-powered turbines, with more being built, operate in Southaven, Mississippi to power a large xAI data center just to the north in Memphis, Tennessee. Demanding that xAI’s illegal power plant be immediately shut down What happened: Elon Musk’s xAI has been illegally operating a massive gas turbine power plant for its data center in Memphis. The power plant lacks a required Clean Air Act permit and is a major source of air pollution. What we did: In April, we filed a court request on behalf of our client, the NAACP, for immediate action to stop the air pollution from the unpermitted gas turbines. Now, we’re asking the court to halt the power plant's operations with a preliminary injunction while it hears our case. Why it matters: xAI's failure to obtain a Clean Air Act permit for its power plant — located near homes, schools, and churches — poses enormous health risks to families in North Mississippi and Memphis. Gray wolves and young playful pups stand on the edge of a lake Protecting our court win against Oregon’s largest gas utility What happened: Oregon’s largest gas utility, NW Natural, is trying to overturn a major legal victory that Earthjustice and our partners won two years ago to help protect the company’s customers from skyrocketing energy bills. What we did: In 2022 and 2024, Earthjustice litigation successfully removed hidden expenses from energy bills by highlighting that NW Natural was illegally charging households for pro-gas and anti-climate lobbying. Oregon’s state regulators in 2024 also ordered the utility to phase out gas line extension subsidies entirely by 2027. The win saved customers $13.7 million by barring overspending on pipe expansions. Why it matters: NW Natural is appealing the order from Oregon’s Public Utility Commission, but we are fighting back to protect it. Keeping this order in place will help contain rising costs by shaving millions of dollars off future rate hikes — and help the Pacific Northwest meet its goals to reduce carbon emissions to help mitigate climate change. Columbia Basin Pygmy Rabbit Going to court for the small but mighty pygmy rabbit What happened: The U.S. Fish & Wildlife Service has yet to decide whether to list the pygmy rabbit as threatened or endangered, two years after it was legally required to do so. It appears that the agency won’t act until fiscal year 2028 at the earliest. What we did: Earthjustice requested a court order requiring the Fish & Wildlife Service to decide whether to grant protections to the rabbit under the Endangered Species Act (ESA). Why it matters: For such a tiny creature, the pygmy rabbit faces a huge array of threats from oil and gas development, grazing, and habitat loss. Not only would an ESA listing help save this imperiled species — it would also help to preserve the rapidly disappearing Sagebrush Sea, which supports an extraordinary diversity of plants and animals and is integral to the wild character of the Intermountain West.
