Insurrection Act Fear - 4/20 review of border deadline!
To: Sen. Kaine, Sen. Warner
From: A constituent in Arlington, VA
April 7
Our constitutional separation of powers faces an imminent threat. By April 20th, a DOD/DHS report may recommend invoking the Insurrection Act, ostensibly for border security but with concerning implications for political dissent nationwide.
Consider:
- The President has explicitly mentioned using the Insurrection Act
- At rallies, he stated regarding protesters: "The next time, I'm not waiting"
- Security experts warn this could be "a prelude to greater restriction of freedoms" targeting "blue-state cities"
- The Act's vague language allows virtually unchecked deployment of military force on US soil
- The Supreme Court ruled in 1827 that presidential determinations under this Act face no judicial review
The Senate must act through:
1. Exercising your advice and consent power by questioning relevant officials in confirmation hearings
2. Employing Senate Rule XIV to fast-track legislation clarifying and limiting the Insurrection Act
3. Using Senate committees to investigate the constitutional implications of domestic military deployment
Your constitutional duty requires immediate action to preserve the balance of powers our founders established.
With grave concern and urgency I implore you to act.
