It is deeply concerning that HR 9495, if passed, would grant the Secretary of the Treasury sweeping and unchecked power to unilaterally revoke the tax-exempt status of nonprofits by labeling them "terrorist-supporting organizations" without due process or the ability for targeted groups to effectively appeal. This legislation poses a grave threat to constitutional rights, enabling viewpoint-based discrimination against civil society groups whose advocacy may be viewed as counter to the administration's agenda. Stripping organizations of tax-exempt status through such an opaque and arbitrary process, without requiring the government to provide full evidence, violates fundamental principles of due process and free speech. Nonprofits and philanthropic groups across the spectrum have sounded the alarm that this bill creates a pathway for the politicized targeting and silencing of dissenting voices. Rather than empowering authoritarianism, Congress should uphold democratic norms and reject measures that undermine civil liberties. This bill must not become law.
