I am writing to express my grave concern regarding the implementation of SB 104 (the "Protect All Students Act"). As this law moves into full enforcement across Ohio’s educational institutions, it is becoming clear that the General Assembly has created an unsustainable legal and financial crisis for our schools.
By mandating bathroom and locker room access based on "biological sex," SB 104 places Ohio schools in direct conflict with federal Title IX protections. This is not a matter of partisan preference; it is a matter of institutional competency. This conflict exposes our school districts and universities to significant federal funding cuts and inevitable, costly litigation.
The rule of law requires that state statutes remain consistent with constitutional protections, specifically the Equal Protection Clause of the 14th Amendment. SB 104 fails this standard by mandating disparate treatment of students without a compelling state interest.
I urge you to support a legislative stay or a full repeal of SB 104 to protect Ohio’s educational budgets from the legal liabilities created by this unconstitutional mandate. We need a legislature that prioritizes statutory stability over performance-based legislation.
