An Open Letter

To: Sen. Budd, Rep. Edwards, Sen. Tillis

From: A constituent in Asheville, NC

June 19

I am writing to demand that you actively defend and uphold the Supreme Court’s decision in Olmstead v. L.C.—a cornerstone of disability rights that affirms the right of people with disabilities to live in the community, not be forced into institutions. Recent policy discussions and proposals raise serious alarm. Efforts that weaken community-based services, reduce funding for home- and community-based care, or expand pathways to institutionalization directly contradict the spirit and legal mandate of Olmstead. Any move in this direction is not only discriminatory—it is a regression to a darker era of segregation and loss of autonomy for disabled Americans. Equally troubling are indications that disability benefits and healthcare systems may be targeted in ways that threaten both financial independence and personal privacy. Disabled individuals rely on these supports to survive and participate in society. Policies that undermine access, redirect benefits, or erode HIPAA protections are unacceptable and must be opposed. Let me be clear: forced or coerced institutionalization is not care—it is a violation of civil rights. Disabled people have the right to live in their homes, make their own choices, and remain integrated in their communities with appropriate supports. I expect you to: • Publicly affirm your commitment to the Olmstead decision and the Americans with Disabilities Act. • Oppose any legislation or administrative action that incentivizes or expands institutionalization. • Protect and strengthen funding for home- and community-based services (HCBS). • Safeguard the privacy and security of disabled individuals’ medical information under HIPAA. • Ensure that disability benefits remain accessible, adequate, and free from exploitation. This is not a partisan issue—it is a human rights issue. Millions of Americans depend on these protections. I will be closely watching your actions on this matter. I urge you to stand firmly on the side of dignity, autonomy, and justice.
