Do not confirm Robert Tracci.
To: Sen. Kaine, Sen. Warner
From: A constituent in Charlottesville, VA
August 22, 2025
When you recommended Robert Tracci for US Attorney, you wrote “We believe that any of these candidates would make an excellent U.S. Attorney, and we are honored to be able to recommend them to you,” in a letter to President Trump.
Robert Tracci, through malice or incompetence, botched the case of Jason Kessler by failing to prove venue. Kessler was the organizer of the Unite the Right Rally that took place on August 11 and 12, 2017 and resulted in the death of Heather Heyer. As a result of Tracci’s error in this case, Kessler went free. See https://c-ville.com/kessler-perjury-charge-tossed/
The stakes were higher than his infamous blunder, though: Mr. Tracci opposed a civilian review board of police conduct, referred to Charlottesville activist groups as “disruptive,” and failed to bring charges against a group of white supremacists who threatened students with lit torches. More broadly, he operated under the approach that removing people from the community and sending them to prisons and jails was a solution to crime.

According to a report released in 2020, race was the best predictor of how many charges would be associated with a single arrest for Black men during Tracci’s time in the Albemarle Commonwealth Attorney Office. (See https://dailyprogress.com/dailyprogress/report-finds-racial-disparity-at-almost-every-level-of-local-criminal-justice-system/article_8c1dad70-7e3a-565b-a98c-f9bc4a189862.html ) The results found that the race of the accused exerted an even “greater statistical influence than both the seriousness of the violation and prior criminal history, combined.”
Do you still believe that such a person would “make an excellent US Attorney”?
Will you promise to vote no to confirm Tracci if appointed, even though you recommended him?
