I am writing to urge you to take immediate legislative action to close the legal loopholes that allow ICE agents to violate civil rights without consequence. Specifically, I am asking you to support the Qualified Immunity Abolition Act, championed by Congresswoman Ayanna Pressley.
Currently, federal agents—including those within ICE—operate behind a shield of "qualified immunity" and legal loopholes in Section 1983 that make it nearly impossible for victims of federal misconduct to seek justice in court. This creates a double standard where federal law enforcement is held to a lower standard of accountability than state and local police.
To restore the rule of law and protect our communities, I ask that you support a legislative framework that:
1. Amends the law to ensure federal agents can be sued for constitutional and civil rights violations, just as state and local officials can.
2. Abolishes the doctrine of qualified immunity, which currently protects bad actors from civil liability even when they break the law.
No one, regardless of the uniform they wear or the agency they work for, should be above the law. I look forward to hearing your position on this critical issue and seeing you stand up for federal accountability.
