Demand Investigation Into Shutdown of Clean Water Act Criminal Probe
To: Sen. Curtis, Rep. Maloy, Sen. Lee
From: A constituent in Salt Lake City, UT
June 8
The Trump administration ordered federal prosecutors to stand down on a criminal investigation into Clean Water Act violations by Governor Jim Justice's coal operations — and you need to demand a full accounting of that decision immediately. This isn't a policy disagreement. This is the Office of the Deputy Attorney General killing an active multi-agency investigation involving the EPA, DOJ's Environmental Crimes Section, and the U.S. Attorney's Office of the Western District of Virginia.
Rick Mountcastle, a federal prosecutor with 24 years in that district, said he had "never heard of that happening before." Justice is a Republican senator elected in 2024 with Trump's direct endorsement. The conflict of interest here is not subtle. If the administration can shut down a criminal environmental investigation to protect a political ally, no Clean Water Act enforcement is safe.
I want you to call for a congressional investigation into who gave the order, why, and what communications passed between the White House and the Deputy Attorney General's office. The people downstream of Justice's mining operations deserve to know their water is protected. That protection just got stripped away for political reasons, and silence from Congress makes you complicit in it.
