The proposed NO FAKES Act poses a grave threat to online speech, innovation, and anonymity. This misguided legislation would mandate overly broad content filters, censor legitimate creative works under the guise of fighting misinformation, and enable the unmasking of anonymous speakers through subpoenas issued without judicial oversight. Rather than addressing actual harms in a targeted manner, the bill creates a sweeping new intellectual property regime that would stifle free expression, undermine fair use rights, and cement the dominance of Big Tech companies at the expense of smaller competitors and individual creators. Moreover, the bill's provisions targeting tools used for generative AI would have a deeply chilling effect on technological progress, allowing platforms to be taken offline based on mere allegations rather than proven violations. This draconian approach fails to strike the appropriate balance between legitimate concerns around digital forgeries and the vital need to safeguard freedom of speech, access to information, and the open internet. For these reasons, the NO FAKES Act must be firmly rejected. Instead, policymakers should pursue narrowly tailored solutions that directly address verifiable harms without compromising fundamental rights or kneecapping innovation. The open internet has flourished because of its decentralized nature and lack of overly restrictive gatekeepers. Imposing a new censorship regime would undermine those core principles to society's detriment. I urge you to stand against this dangerous legislation and protect the free and open internet.
