Protect rights of disabled citizens, uphold Section 504

To: Rep. Lopez, Gov. Braun, Sen. Baldwin

Indiana's decision to join the federal lawsuit aimed at declaring Section 504 of the Rehabilitation Act unconstitutional is concerning. Section 504 serves as a crucial civil rights law that protects individuals with disabilities from discrimination and ensures their equal access to programs and activities receiving federal funding. Challenging the constitutionality of this Act undermines the rights and well-being of a vulnerable population that has historically faced significant barriers and marginalization. While the state argues against the recent addition of "gender dysphoria" to the definition of disability under Section 504, the lawsuit goes beyond this specific issue. It seeks to nullify the entire Act, which would strip away essential protections for individuals with various disabilities across healthcare, education, transportation, and other vital sectors. This approach is misguided and fails to uphold the principles of inclusivity and equal opportunity that a just society should embody. Instead of pursuing legal action that could potentially erode hard-won civil rights protections, the state should focus its efforts on fostering an environment that embraces diversity, promotes accessibility, and empowers individuals with disabilities to participate fully in all aspects of life. Collaborative dialogue and constructive solutions that align with the spirit of Section 504 would be a far more productive approach. It is imperative that the rights and well-being of individuals with disabilities remain a priority. Stripping away the fundamental safeguards provided by Section 504 would be a regressive step that undermines the progress made toward creating a more inclusive and equitable society. I urge the state to reconsider its position and work towards strengthening, rather than weakening, the protections afforded to this vulnerable community.
