I am writing as your constituent to express my firm opposition to House Bill 347, currently pending in the Senate. This legislation is a transparent attempt to subvert the will of Ohio voters who overwhelmingly approved the Reproductive Freedom Amendment in 2023. HB 347 fails the test of Institutional Competency and Rule of Law for the following reasons: - Failure of Narrow Tailoring: The 24-hour waiting period and mandatory state-scripted disclosures are not common-sense regulations. They are unconstitutional burdens that provide no medical benefit and serve only to obstruct a fundamental right guaranteed by the Ohio Constitution. - Void for Vagueness: The bill allows the State Medical Board to expand disclosures as "science evolves," creating a standardless, subjective environment that invites arbitrary enforcement and violates Due Process. - Legislative Liability: Passing laws that directly contradict a recently passed constitutional amendment guarantees expensive, protracted litigation. It is a fiscally irresponsible use of state power to invite a constitutional challenge that the state is legally certain to lose. I urge you to reject HB 347 in committee or vote against it on the floor. I will be monitoring this vote as a litmus test for your commitment to the Rule of Law and the clear mandate provided by Ohio voters.
