AZ SB 1352
To: Gov. Hobbs, Sen. Bolick, Rep. Simacek, Rep. Wilmeth
From: A constituent in Phoenix, AZ
February 20, 2025
I'm writing to express my concerns regarding Arizona Senate Bill 1352 (SB1352), which addresses rezoning and administrative acts. As a building engineer, I've navigated the challenging terrain of permits and approval processes many times. I understand firsthand how difficult and lengthy these procedures can be. They often require meticulous attention to detail, extensive documentation, and coordination with multiple agencies. While this can be frustrating and time-consuming, I firmly believe these processes are ultimately for the public good. The rigorous permits and approval system serves as a critical safeguard, ensuring developments are safe, sustainable, and in harmony with the community's needs. They facilitate thorough reviews that consider environmental impact, structural integrity, and compliance with zoning laws. While SB1352 aims to streamline administrative procedures, I'm concerned it may inadvertently diminish valuable public input in the zoning and development of our land. Communities deserve the opportunity to provide active input into the zoning of their neighborhoods. The residents who live and work in these areas have a vested interest in how they develop, and their insights can lead to more thoughtful and effective planning. Streamlining processes might sound like a path to efficiency, but it can be counterintuitive to the reality of building thriving communities. By cutting short the approval processes, we risk overlooking the long-term investment and well-being of the people who will be directly affected by these developments. Public participation isn't just a procedural hurdle; it's a cornerstone of democratic governance and community development. By prohibiting referrals related to rezoning, SB1352 could reduce transparency and limit the public's role in critical decisions. This shift may prioritize speed over quality, potentially leading to developments that don't fully reflect the community's needs or values. The bill states, “Notwithstanding any other law, the approval by the legislative body of an application for rezoning pursuant to this section is an administrative act and is not subject to the filing of a referendum petition by a person or organization.” This provision effectively removes a vital check in the rezoning process, depriving community members of their right to challenge and influence decisions that significantly impact their environment and quality of life. I urge you to consider the broader implications of SB1352. Let's strive for a balanced approach that maintains necessary efficiency without sacrificing the essential input and oversight from our communities. The goal should be to facilitate development that is not only swift but also sustainable, safe, and aligned with the aspirations of the people it will serve. I appreciate your dedication to representing our community's best interests and look forward to your thoughtful consideration of these concerns.
