The Trump administration's refusal to ensure the return of Kilmar Abrego Garcia, a Salvadoran national wrongly deported despite a judge's order, sets a dangerous precedent that threatens the constitutional rights of all people in the United States, including citizens. The administration claims the president's authority over foreign affairs allows him to disregard court orders regarding deportations, effectively denying due process enshrined in the Fifth and Fourteenth Amendments. However, constitutional scholar Kim Wehle argues that implying the president can deprive anyone of liberty without notice or opportunity to be heard grants the executive unlimited power akin to an absolute monarchy rejected by the nation's founders. This unlawful overreach jeopardizes a core principle dating back to the Magna Carta - that no person shall be deprived of life, liberty or property without due process of law. If left unchecked, the administration could potentially remove U.S. citizens from the country under the guise of foreign policy, stripping them of their constitutional protections. We cannot allow the executive branch to trample on fundamental rights through such dangerous legal reasoning. I urge you to take immediate action to restore the system of checks and balances and uphold due process for all people on American soil, regardless of immigration status. The preservation of these inalienable rights is crucial to maintaining the rule of law and democracy itself.
