No SB1003 - No Bathroom Laws for Children

To: Sen. Bolick, Rep. Simacek, Rep. Wilmeth, Gov. Hobbs

From: A constituent in Phoenix, AZ

February 20, 2025

I am writing to express my strong opposition to Arizona Senate Bill 1003 (AZ SB 1003). While the bill is intended to provide reasonable accommodations for students, it falls short in several critical areas and raises significant concerns about the safety and well-being of all children, particularly transgender children. First and foremost, the language used in the bill, specifically the definition of "sex" as a person's immutable biological sex, fails to acknowledge and respect the gender identities of transgender and gender-nonconforming individuals. This exclusionary language can lead to further stigmatization and discrimination, rather than providing the inclusive and supportive environment that all students deserve. By allowing schools to deny reasonable accommodations based on the rigid definition of biological sex, the bill opens the door for arbitrary and discriminatory decisions that can harm vulnerable students. Transgender children, in particular, may face significant challenges in accessing the accommodations they need, which can have severe consequences for their mental and physical well-being. Additionally, it's important to note that children do not go about their daily lives carrying identification or birth certificates. This reality leaves room for administrators to take advantage of young children under the guise of enforcing the law. Such situations can result in undue hardships and potential abuse of authority. The bill also fails to address the broader context of students' rights and freedoms. The requirement for students to request accommodations in writing and the potential for legal action if accommodations are denied places an undue burden on students and their families. This process can be intimidating and inaccessible, especially for those who lack supportive home environments. In light of these concerns, I urge you to reject AZ SB 1003 and advocate for legislation that genuinely protects the rights and safety of all students. It is essential to ensure that any policies enacted are inclusive, respectful, and supportive of diverse identities, and that they do not create additional barriers for vulnerable populations. Thank you for your attention to this critical issue. I appreciate your commitment to promoting the well-being and equality of all students in our state.
