Reject Unconstitutional Bill Mandating Bible Readings in Public Schools

To: Gov. Little, Sen. Nichols

From: A constituent in Nampa, ID

February 9, 2025

The introduction of a bill requiring daily Bible readings in all Idaho public schools raises serious constitutional concerns. While freedom of religion is a fundamental right, compelling public schools to engage in religious practices violates the critical separation of church and state enshrined in the Establishment Clause. Promoting one particular religious text in the secular domain of public education amounts to an unconstitutional government endorsement of religion. Numerous court precedents, including the 1963 Abington School District v. Schempp decision, have firmly established that state-sponsored Bible readings in public schools are an impermissible breach of this constitutional principle. Although recent rulings have adopted a "historical practices" test, the establishment of public education itself post-dates the adoption of the First Amendment, casting doubt on the relevance of such an analysis here. Moreover, the bill appears to directly contravene provisions of the Idaho Constitution prohibiting the teaching of sectarian doctrines or use of religious texts in public schools. A 2015 legal opinion cautioned that permitting the use of the Bible as a reference text would likely be unconstitutional under state law. While the advancement of this legislation may be well-intentioned, it threatens to undermine the religious neutrality that public schools must maintain. Preserving a robust separation between church and state safeguards the religious liberty of all citizens, regardless of their beliefs. I urge you to consider these grave constitutional implications and reject measures that could compromise this foundational principle.
